# Article 34 — Committee procedure

**Source:** [Regulation (EU) 2023/1113 — EUR-Lex](https://eur-lex.europa.eu/legal-content/EN/TXT/?uri=CELEX%3A32023R1113)

1. The Commission shall be assisted by the Committee on the Prevention of Money Laundering and Terrorist Financing. That Committee shall be a committee within the meaning of Regulation (EU) No 182/2011.
2. Where reference is made to this paragraph, Article 5 of Regulation (EU) No 182/2011 shall apply.

## What this means in practice

Standard EU **Comitology plumbing**. Where ToFR refers to "Article 34(2)" (e.g. Art. 35(6) for derogation decisions), the Commission must use the **examination procedure** under [Regulation (EU) No 182/2011](https://eur-lex.europa.eu/legal-content/EN/TXT/?uri=CELEX:32011R0182): a vote by a committee of Member State representatives, with the option of escalating to an appeal committee where required.

This is supervisory mechanics — no direct compliance obligation for CASPs.
